Please read these terms carefully before using the Time Off service. By registering or using the Service, you agree to be bound by these terms.

Acceptance of Terms

By registering for and using the Time Off application ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

Service Description

Time Off is a vacation and leave management application that helps organizations track employee time-off requests, approvals, and balances. Access to specific features (such as automated document generation or advanced imports) depends on the active subscription tier selected by the tenant. The Service is provided on an "as is" and "as available" basis, except as otherwise agreed in a separate Enterprise service agreement.

Accuracy of Information

We strive to ensure that the Service operates correctly and that all calculations, reports, and records are accurate. However, we do not warrant that the Service will be error-free, uninterrupted, or free of defects. While we make every reasonable effort to maintain the accuracy and reliability of the data processed by the Service, we cannot guarantee absolute precision in all circumstances.

Limitation of Liability

This section limits the Service provider's legal liability. Enterprise agreements may include different terms.

Except as otherwise agreed in a separate Enterprise service agreement, to the fullest extent permitted by applicable law, the Service provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with the use of or inability to use the Service.

The Service provider shall not be held responsible for any errors, inaccuracies, or discrepancies in vacation day calculations, leave balances, approval workflows, or generated documents. Users and tenant administrators are responsible for verifying the accuracy of all data and reports.

User Responsibilities

Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. Users should promptly notify their tenant administrator of any unauthorized use of their account or any other breach of security.

Data and Privacy

We process personal data necessary for the operation of the Service. Each tenant's data is logically separated and accessible only to authorized users within that tenant. We take reasonable measures to protect your data, but cannot guarantee absolute security.

All personal data is stored on cloud infrastructure located in Frankfurt, Germany (European Union). Data is not transferred outside the European Economic Area. The Service provider implements appropriate technical and organizational measures in accordance with applicable data protection regulations, including GDPR where applicable.

For the purposes of data protection laws, the tenant organization is the Data Controller, and the Service provider acts solely as the Data Processor.

Data Retention

Upon termination of the Service or a tenant's account, personal data will be retained for a maximum of 30 days to allow for data export, after which it will be permanently and securely deleted. Tenants are responsible for exporting any required data prior to account closure. The Service provider shall not be liable for any data loss resulting from failure to export data within this period.

Payment Terms

The Service is available under monthly or yearly billing plans.

Definition of Active User

For billing purposes, an "Active User" is any unique user account that is Enabled within the tenant's dashboard at any point during the billing cycle, regardless of whether the user actually logs in.

Payment terms vary depending on the selected billing cycle:

Monthly Billing

Invoices are issued at the end of each calendar month based on the peak number of active users recorded during that month.

Yearly Billing

Payment is due at the start of the billing period for a fixed number of users. If active users exceed the contracted amount by more than 5% at any point, a supplementary invoice will be issued at the end of the year.

All payments are made via standard B2B bank transfer, due within 14 days of invoice issuance. The default currency is RSD (Serbian Dinar); invoices may be issued in EUR for entities registered outside of Serbia.

All fees are non-refundable unless otherwise stated. Failure to pay by the due date may result in downgrading the account to the Free tier, or suspension/termination of access to the Service.

Termination

Either party may terminate the agreement with 30 days' written notice.

For the Tenant

Notice must be sent via email to contact@time-off.rs from an authorized administrator's email address.

For the Service Provider

Notice will be sent to the email address of the tenant's primary administrator, or via a prominent notification within the Service dashboard.

Force Majeure

The Service provider shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from causes beyond its reasonable control, including but not limited to: acts of God, flood, fire, earthquake, or explosion; war, invasion, hostilities, terrorist threats or acts, riot or other civil unrest; government order, law, or actions; embargoes or blockades; national or regional emergency; strikes, labor stoppages or slowdowns; or systemic electrical, internet, or telecommunication service interruptions.

Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Serbia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Republic of Serbia.

Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Continued use of the Service after any changes constitutes acceptance of the updated terms.
